Full Terms and Conditions – The Big Farm Giveaway (BFGA)

1 Qualifying Persons

1.1 The Big Farm Giveaway Best (‘BFGA’, ‘Promoter’, ‘our(s)’) operate competitions – skilled prize competitions resulting in the allocation of prizes in accordance with these Terms and Conditions at selected agricultural retail locations, outlets and events and on the website: https://www.thebigfarmgiveaway.co.uk/ (The ‘website’) – (The ‘competition(s)’).

1.2 The Competitions are open to all persons aged 16 and over and the age of majority in their country of residence excluding the Promoter’s family members, agents or any other person who is connected with the creation or administration of our competitions.

2 Legal Undertaking

2.1 By entering a competition the entrant (‘entrant’, ‘you’, ‘your(s)’) will be deemed to have legal capacity to do so, you will have read and understood these Terms and Conditions and you will be bound by them and by any other requirements set out in any related promotional material.

2.2 These competitions are governed by English Law and any matters relating to the competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

2.3 In the event that you participate in a competition online via the website, and by accepting these Terms and Conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our competitions.

2.4 The Promoter will not be held responsible for any Entrant entering any of our competitions unlawfully.

2.5 If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

3 Competition Entry

3.1 These competitions may be entered at our nominated outlets as per 1.1 above or other physical sites (locations are detailed on the website), (‘Physical Locations’) and online via the website.

3.2 There is a single category of our Competitions: The Big Farm Giveaway competition. One or more competitions may be operated at the same time and each competition will have specific prize options.

3.3 Availability and pricing of competitions and tickets is at the discretion of the Promoter and will be specified at the point of sale in our outlets, physical locations and on the BFGA website.

3.4 Postal Entry Route: If you wish to enter any of our competitions for free then you must send an unenclosed postcard via First Class post stating: which competition you would like to take part in; the answer to the question specific to the competition you wish to enter; your personal details as follows:

Entrants MUST have an active account on our website at the time the free entries are processed, all details on postcards MUST match those on the account to which they are to be added. Free entries are limited to one per person per competition.

All free entries must be received before the close of the competition, any entries that fail to follow the criteria mentioned above will be void as per any entry received. A member of the The Big Farm Giveaway team will check for all free entries on the last Friday of every month only. Any postal entries received after the deadline or after the ticket allocation has been reached will also become void.

4 Your BFGA Account(s)

4.1 In order to enter a Competition, you will need to register an account with us.

4.2 You can register an account in two ways: Online at https://www.thebigfarmgiveaway.co.uk/ or at one of our outlets (including shows and trade stands.)

4.3 To register an account online you will be asked to provide an email address or sign in via a social media account, such as Facebook, Twitter or Google (‘Social media account’)

4.4 To register an account at an outlet or other physical location you will be asked to provide an email address.

4.5 Please note that your email address or social media account will also be the user name that you use to log into your account.

4.6 Each account can only have one username attributed to it at any given time (“BFGA Account”). Therefore, you cannot attribute multiple email addresses, or social media accounts to your BFGA Account.

4.7 You can however, change your username for your BFGA account by logging into your BFGA account. For example, you can create your BFGA account using one email address and at a later date change your username for your BFGA account to another email address. However, if you create multiple accounts using different email addresses or social media accounts, each username will be treated as a separate BFGA account.

4.8 To enter a competition at an outlet or other physical location such as a trade show or agricultural venue, you will need to complete the following:

4.9 Complete an electronic account of provide your email details to our representative.

4.10 Complete a prize entry ticket including completion of all questions shown on the ticket.

4.11 Pay the required fee.

4.12 Hand your completed ticket to our representative or if completed at a later date, send by post to the address on the ticket within 4 working days of the advertised prize draw date.

4.13 You will be emailed an acknowledgement on receipt of your ticket with your entry status (questions answered correctly/incorrectly) details and a link to your registered online account.

4.14 You will need to check your details carefully and confirm to the Promoter’s representative that you have read and understood the declaration and the competition Terms and Conditions.

4.15 You may enter as many times as you like for each competition to a maximum of 25 entries.

4.16 You will require one ticket for each entry.

5 Contravened any of these Terms and Conditions

5.1 To the extent permitted by applicable law, all entries become our property and will not be returned.

5.2 Entries (tickets) are limited to twenty-five (25) per person, per competition.

5.3 Abuse of this limit will not be tolerated and if the Promoter has reasonable grounds to believe that an individual is exceeding this limit, for example by entering a competition using multiple accounts, it reserves the right at its sole discretion to void all tickets.

5.4 In addition, if any person using a single account exceeds 25 entries (in a single competition for any reason, the Promoter reserves the right at its sole discretion, to void any tickets without notice firstly on a chronological basis with respect to orders, and then on a sequential basis with respect to ticket references contained within an order, so as to void any tickets exceeding the first 25 paid tickets entered into the competition.

6 Promotion Periods

6.1 Each competition will run for a specified period. Please see each competition for details of start and end times and dates (‘Promotion period(s)’).

7 Competition Judgement – The Big Farm Giveaway

7.1 All tickets received before the notified cut-off period will be considered for entry into the prize draw.

7.2 All tickets will be checked for the correctness of answers.

7.3 Those tickets containing 100% correct answers will be entered into a randomised draw.

7.4 All draws will be conducted by an independent adjudicator whose decision is final.

7.5 The name and contact details of the independent adjudicator will be published 7 days prior to each draw.

7.6 All draws will be live streamed via Facebook.

7.7 The winner will be selected by an industry standard random number generator.

7.8 All tickets entered into the prize draw will be allocated a unique draw number. (To enable a correlation with the random number generator.) immediately prior to the draw.

7.9 The number of winning tickets will be drawn depending on the prizes available. (Each draw will have between 1 and 5 prizes.)

7.10 The 1st ticket drawn will be awarded 1st prize, 2nd, 2nd prize etc.

7.11 All winners will be contacted via their nominated contact details.

7.12 The promoter does not assume any responsibility for the correctness of these.

7.13 All prizes must be claimed within 5 working days if the Promoter is unable to make contact by all available means provided.

7.14 If a prize is unclaimed after this period a one off additional draw will be carried out under the same strict terms and conditions for the BFGA.

7.15 The winner/s will be contacted within 24 hours of the end of the draw.

7.16 The Promoter will attempt to contact the winner using the telephone numbers and email address provided at the time of entry (or as subsequently updated) and held securely in our database.

7.17 It is the entrant’s sole responsibility to check and update these details.

7.18 If for any reason they are taken down incorrectly, the Promoter will not be held responsible.

7.19 Entrants must carefully check their contact details have been recorded correctly.

7.20 If for any reason the Promoter is unable to contact a winner within 5 days (which may be extended at the sole discretion of the Promoter) of the end of a competition or the winner fails to confirm acceptance of the prize or the winner is disqualified as a result of contravening any of these Terms and Conditions, the winner will forfeit the prize.

7.21 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.

7.22 The Promoter may in its sole discretion cancel, terminate, modify or suspend a competition, or invalidate any affected entries.

7.23 In the event that the Promoter closes a competition early, the winner may be selected from all valid and eligible entries received by the Promoter prior to the date of closure, except that the Promoter reserves the right, at its sole discretion, to close a competition early without selecting a winner.

7.24 In the event that a competition is closed without selecting a winner, the Promoter will give all entrants BFGA credits to enable them to replay equivalent tickets in a subsequent competition.

7.25 All entrants are automatically entered onto the Promoter’s database for the purpose of conveying information as to the status of their competition, as well as any future promotions or competitions offered by the Promoter.

8 Winner’s Details

8.1 The winner will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered.

8.2 Any failure to meet these obligations may result in the winner being disqualified and the Promoter choosing an alternate winner.

8.3 The winner will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the competition and in identifying them as a winner of a competition.

8.4 Following receipt and verification of the details requested above by the Promoter, the winners will be contacted in order to make arrangements for delivery of the prize. At this point the winners must choose between the prizes available (as detailed in the competition prize information on the website) and notify the Promoter of their choice in writing.

8.5 Surprise contact details: On your account page you have the option to add the contact details of an individual who we can contact to help arrange with the surprise if you are a winner. We will categorically not share or pass these details on to any third party but in adding them you are confirming that you have the consent from the person to pass these details to BFGA.

9 Competition Prizes

9.1 BFGA: Competitions are comprised of many different agricultural machinery prizes.

9.2 For the avoidance of doubt, there will be only one 1st prize awarded for each draw (‘First prize’) with additional supplementary prizes also offered depending on the format of each draw.

9.3 First prize: The Promoter reserves the right to award a selection of substitute agricultural machinery prize equal or greater value.

9.4 If any one draw fails to meet the market value of the prize offered the 1st prize will be replaced with a cash prize amounting to 70% of all ticket receipts.

9.5 The remaining 30% will be used for administration of the draw with any surplus being carried over to the next prize draw.

9.6 In the UK the First Prize will be delivered with UK VAT paid.

9.7 In the EU the First Prize will be delivered with UK VAT paid but any further costs (additional VAT/taxes/import duties/registration costs due in the destination/country of final registration) will be the responsibility of the First Prize Winner.

9.8 In all other countries the first prize will be shipped (net of all taxes) to the nearest port and any applicable import duties, registration costs, or any further taxes or duties of any nature due in the destination country will be the responsibility of the First Prize Winner.

9.9 For winners outside of the UK, (including the Republic of Ireland), the prize will only shipped to the nearest mainland British port.

9.10 The Promoter reserves the right not to deliver to certain countries. Please note that all our machinery is supplied in the UK and therefore if exported may not be road legal in the destination country.

9.11 It is the First Prize Winner’s responsibility to check this and choose an alternative car or take the cash alternative if appropriate.

9.12 For the avoidance of doubt, the maximum value that The Promoter will be liable to pay for or towards any prize is the UK RRP (or local currency equivalent) of the prize as advertised on our website.

9.13 The Promoter does not imply or give any warranty or accept any valuation to the Prize or guarantee the roadworthiness in anyway shape or form. The Entrant must make up their own decision through their own enquiries and legal advice before entering the competition.

10 Storage

10.1 The Promoter can store the chosen prize free of charge for 30 days after notifying the First Prize Winner, at the end of which time the First Prize will be delivered to the Winner.

11 Winners’ Personal Data

11.1 Acceptance of the prize by the winner will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public relations and marketing), both immediately after their win and in the future for use in accordance with these terms and conditions, unless prohibited by law.

11.2 By entering a competition, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (save for reasonable travel expenses) and as required by the Promoter if you are declared a winner.

12 Limits of Liability

12.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes, except for liability for death or personal injury caused by the negligence of the Promoter.

12.2 The Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the winner(s), or in connection with any of the competitions promoted by the Promoter.

13 Electronic Communications

13.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes.

13.2 The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant.

13.3 If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the competition prize and award it to the correct entrant, at its sole discretion and without admission of liability.

13.4 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.

13.5 The Promoter may in its sole discretion cancel, terminate, modify or suspend a competition, or invalidate any affected entries.

13.8 The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due.

13.9 The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers.

14 Data Protection Notice

14.1 Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the competition and fulfil prizes where applicable.

14.2 In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you; (iii) any person to whom the Promoter proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute fraud and other crime.

14.3 In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

15.2 A list of winners and their home town will be available for one (1) month after the end of each competition by sending an email to the Promoter.
